Terms of Service

The terms and conditions for using Image to Layers.

Last updated: 2026-08-22

Effective date: August 22, 2026

Acceptance of Terms

By accessing or using Image to Layers, you agree to be bound by these Terms of Service. If you do not agree, please do not use the service.

Description of Service

Image to Layers is an AI-powered image toolkit. Its core feature decomposes an image you upload into multiple transparent PNG layers; it also offers text removal and AI photo generation. Processing is performed by the following third-party AI models and services, accessed through AI infrastructure providers (fal.ai, APIMart, Evolink):

  • Layer decomposition — Agent Layers uses SAM 3 through fal.ai and GPT-Image-2 through APIMart. The optional VIP Magic Layers mode uses an automatic third-party layer-decomposition service through fal.ai; Qwen-Image-Layered (Alibaba Qwen) is also available. Two-layer workflows may use BiRefNet v2 (subject segmentation) and LaMa (background inpainting).
  • Text removal — Qwen-Image-Edit-Plus (Alibaba Qwen).
  • AI photo generation — GPT-Image-2 (OpenAI), Nano Banana and Nano Banana 2 (Google Gemini image models), Z-Image Turbo (Alibaba), Qwen Image 3.0 (Alibaba), and Seedream 5.0 Pro (ByteDance). The generator interface shows which model each result uses.

We may switch to newer models as providers evolve and will keep this list up to date. We may modify, suspend, or discontinue any part of the service at any time, with reasonable notice where possible.

Accounts

You must create an account to use the service. You are responsible for keeping your credentials confidential and for all activity under your account. Notify us immediately of any unauthorized use.

Credits and Payments

  • The service runs on credits: 1 credit = 1 layer-decomposition task.
  • Credit packs are one-time purchases and do not expire.
  • Pro subscription credits are granted at the start of each billing period.
  • If a decomposition task fails, the credit is refunded to your balance automatically.
  • Prices are shown at checkout. Payments are processed by our payment providers (Stripe, Creem, PayPal). You are responsible for providing accurate billing information. Refund conditions, time limits, and the request process are set out in the "Refunds" section below.

Refunds

If a task fails, the credits it consumed are returned to your balance automatically — you never need to request this.

For payments, the following rules apply.

When you can get a refund

  • Unused credit packs — full refund if you request it within 7 days of purchase and none of the pack's credits have been used.
  • First Pro subscription payment — full refund if you request it within 7 days of your first subscription payment and have used less than 10% of the credits granted for that period. The credits granted for the refunded period are removed when the refund is issued.
  • Duplicate or incorrect charges — refunded in full once verified.
  • Extended service outage — if the service is continuously unavailable for 72 hours or more for reasons attributable to us, subscribers may request a prorated refund for the affected time.

What is not refundable

  • Credits that have been used. Every generation consumes paid third-party AI compute, so consumed credits cannot be refunded — except the automatic refund for failed tasks above.
  • Credit packs more than 7 days after purchase, or once any of their credits have been used.
  • Subscription charges for billing periods that have already started, beyond the first-payment guarantee above. You can cancel anytime in your account settings: cancellation stops future charges, you keep access for the current period, and credits already granted to you remain usable.
  • Dissatisfaction with the style or aesthetics of a successfully completed result. AI output varies with the input image (see "AI Output Disclaimer"), and a completed task has already consumed real compute.
  • Purchases on accounts terminated for violating these Terms.

How to request a refund

Email support@imagetolayers.org or open a ticket via the in-app support button (bottom-right corner of the site), including:

  1. the email address of your account,
  2. the order or transaction ID (from your receipt or the billing page), and
  3. the reason for your request.

We reply within 3 business days. Approved refunds are issued to your original payment method within 5–10 business days; your bank or card issuer may need additional time to post the funds.

Your Content

  • You keep ownership of the images you upload and of the layers generated from them. We never claim ownership of your content, and we do not use it to train AI models.
  • You represent that you own or have the necessary rights to any image you upload. Do not upload images you have no right to use.

Paid results are private

Once you have bought any credit pack or subscription, every result on your account is private: visible only to you, never displayed on this site, and covered by a commercial-use licence. This applies to your whole account, including anything you generated before you paid — buying converts your existing results to private as well.

Results from signup credits are public

Results generated with the credits we grant on signup, and by any account that has never made a purchase, are marked public. For these results only, you grant us a non-exclusive, worldwide, royalty-free licence to display, reproduce, and promote them on this site and in our marketing materials, with attribution at our discretion. You keep ownership throughout, and this licence does not permit us to sell them or sublicense them to third parties.

Public results do not include a commercial-use licence — to use a result commercially, buy a credit pack or a subscription.

Not every public result is displayed. We only publish results we select individually; marking a result public grants the right to display it, it does not put it on the site automatically.

If you want a result taken down or made private, buy any credit pack or plan, or contact us — we will honour reasonable removal requests.

Acceptable Use Policy

Prohibited content

You must not upload, or attempt to generate with any feature of the service, content in the following categories:

  1. Sexual / NSFW content — pornography, nudity, sexual acts, or sexually suggestive material. This is strictly prohibited regardless of the age or apparent consent of the people depicted.
  2. Child sexual abuse material (CSAM) and any other content that sexualizes or endangers minors. Where required by law, we report such material to the relevant authorities.
  3. Violence and gore — content that graphically depicts or glorifies violence, gore, self-harm, or cruelty to people or animals.
  4. Hate speech — content that attacks, demeans, or incites hatred or discrimination against people based on race, ethnicity, religion, nationality, gender, sexual orientation, disability, or similar attributes.
  5. Deepfakes and impersonation — realistic depictions of identifiable real people without their consent, including non-consensual intimate imagery, fabricated events presented as real, and content intended to impersonate or defame someone.
  6. Copyright or trademark infringement — images you have no right to use, or content that infringes others' copyright, trademark, privacy, or publicity rights.

An automated safety checker may block prohibited content, and blocked tasks may still consume review resources. Violations can lead to content removal and account suspension or termination.

Prohibited behaviour

You also agree not to:

  • Violate any applicable laws or regulations.
  • Attempt to gain unauthorized access to our systems, abuse the credit system, or interfere with the service (including scraping, reverse engineering, or overloading the API).
  • Resell the service itself without our written permission.

Reporting violations

If you find a result on this site (for example in the public gallery) that you believe violates this policy or infringes your rights, report it:

  • Email support@imagetolayers.org with a link to the page or a copy of the image, or
  • Use the in-app support button (bottom-right corner of the site) to open a ticket.

We review every report within 3 business days. Content that violates this policy is removed, and the offending account may be warned, suspended, or terminated. For copyright complaints, please include evidence of your ownership so we can act quickly.

AI Output Disclaimer

Layer decomposition is performed by an AI model. We do not guarantee the quality, accuracy, or fitness of any output. Results vary with the input image, and some images may not decompose well. The service is provided "as is" and "as available", without warranties of any kind, express or implied.

Limitation of Liability

To the maximum extent permitted by law, our total liability for any claim arising out of the service is limited to the amount you paid us in the 12 months before the claim. We are not liable for any indirect, incidental, special, consequential, or punitive damages.

Termination

We may suspend or terminate your access if you violate these Terms, with unused credits forfeited in cases of abuse. You may stop using the service and delete your account at any time through your account settings.

Governing Law

These Terms are governed by the laws of the Hong Kong Special Administrative Region, without regard to its conflict-of-law rules. Any dispute arising out of or relating to these Terms or the service that cannot be resolved informally shall be submitted to the courts of Hong Kong. Before filing any claim, please contact us first — most issues can be resolved quickly through support.

Changes to These Terms

We may modify these Terms at any time. Material changes will be reflected in the effective date above and, where appropriate, announced through the service. Continued use after changes take effect constitutes acceptance.
